16.1 Duty to provide sufficient space

The market owner is under a duty to provide sufficient space for holding the market1 and, if he does not do so, persons may sell outside the market, subject to the payment of tolls, or the franchise may be forfeited. In the case of a market which by the grant is confined to a fixed place, the market owner fulfils his duty if he properly devotes the whole of that place to the purposes of the market2.
