87 Things done in reliance on a design registration

The copyright in an artistic work is not infringed by anything done:

  1. 87.1

        under an assignment or licence made or granted by a person registered:

    1. 87.1.1

          under the Registered Designs Act 1949 as the proprietor of a corresponding design; or

    2. 87.1.2

          under the Community Design Regulation as the right holder of a corresponding registered Community design; and

  2. 87.2

        in good faith in reliance on the registration and without notice of any proceedings for the cancellation or invalidation of the registration or, in the case of registration under the Registered Designs Act
