71 Recording of folk songs

Provision is also made for making a sound recording of a performance of a folk song for the purposes of including it in an archive maintained by a body not established or conducted for profit1 if the following conditions are met:

  1. 71.1

        the words are unpublished and are of unknown authorship at the time the recording is made2;

  2. 71.2

        the making of the recording does not infringe any other copyright3; and

  3. 71.3

        its making is not prohibited by any performer4.

Such a recording will not infringe any copyright in the words or music5. A single copy
