57 Recording by educational establishments of broadcasts

A new Section 35 of the Copyright, Designs and Patents Act 1988 has been substituted for the previous Section 35 by Regulations1, which came into force on 1 June 2014. The new Section 35 is wider, and in particular allows for the benefit of the exception to be enjoyed by students who are using distance learning technology for their studies.

A recording of a broadcast, or a copy of such a recording, can be made by or on behalf of an educational establishment2 for its educational purposes without infringing copyright in the broadcast or
