Text and data mining are techniques for automated analysis of works, and involve copying works and analysing them for patterns, trends and other useful information. They have many potential commercial applications. These technologies usually involve copying entire works and will therefore infringe copyright in those works unless they are licensed. However, the Hargreaves Review of Intellectual Property and Growth1 recommended introducing an exception to copyright to permit the use of such analytics for non-commercial research and that contractual exclusions of this exception should be prohibited.
