40.5.7 FA Premier League v British Sky Broadcasting Ltd

In Football Association Premier League v British Sky Broadcasting Ltd1 the High Court considered whether a company (FirstRow Sports) infringed the Football Association Premier League (‘FAPL’)’s copyright. FirstRow Sports provided an indexing and aggregation portal to streamed broadcasts of sporting events communicated to the public with the FAPL’s copyright works included in the streams. The case differed from Newzbin2 and Dramatico3, as it did not involve a P2P file-sharing website. However, applying the same analysis as in EMI v Sky4, the Court found:
