40.5.10 ‘Popcorn Time’ websites

In April 2015 the High Court for the first time ordered Internet service providers (‘ISPs’) to block access to so-called ‘Popcorn Time’ type websites, of which there are several types1. The claimants applied to the Court expecting the case to be dealt with as a formality on paper, particularly as the ISPs did not oppose the application. However, the Court considered that this case raised different issues from those previously considered in applications for website blocking injunctions, and that the case could not therefore be dealt with on paper alone.
