40.2 Infringement by issue of copies to the public

From 1 December 1996, issuing an original work or copies to the public is an act restricted by the copyright in every description of copyright work and means1:

  1. 40.2.1

        putting into circulation in the EEA copies not previously put into circulation in the EEA by or with the consent of the copyright owner2, or

  2. 40.2.2

        putting into circulation outside the EEA copies not previously put into circulation in the EEA or elsewhere3.

It does not include any subsequent distribution, sale, hiring or loan of copies previously put into circulation or any subsequent
