4 Author

For a work to qualify for copyright protection by reference to its author, it is necessary for the author to be a qualifying person at the material time1. An author will be a qualifying person if:

  1. 4.1

        he is a British citizen, British overseas territories citizen, a British National (Overseas), a British Overseas citizen, a British subject or a British protected person within the meaning of the British Nationality Act 19812; or

  2. 4.2

        he is an individual domiciled3 or resident in the United Kingdom or another country to which the relevant provisions of Part I of the Copyright,
