38.3 Prospective ownership of extended or revived copyright

Where an agreement made before 1 November 2013 provides that the prospective owner of the copyright purports to assign the extended or revived copyright wholly or partially to another person, then if on 1 November 2013 the assignee or another person claiming under the assignee would be entitled as against all other persons to require the copyright to be vested in him or her, then the copyright will vest in the assignee or his or her successor in title1.
