38.1 Ownership of extended copyright

38 Extended and revived copyright—sound recordings and works of co-authorship

The Copyright and Duration of Rights in Performances Regulations 20131 (‘the 2013 Regulations’), which came into force on 1 November 2013, introduced extended copyright and revived copyright in respect of certain sound recordings and works of co-authorship.

Copyright in a work that was in existence immediately prior to 1 November 2013 will continue to subsist until the date on which it would have expired under the provisions in force prior to 1 November 2013, if that date is later than the date on which copyright would expire under the 2013 Regulations2.
