3 General

A work will only be entitled to copyright protection if the qualification requirements of the Copyright, Designs and Patents Act 1988 are satisfied1. The qualifying requirements must be satisfied as regards one of the following:

  1. 3.1

        the author2; or

  2. 3.2

        the country of first publication3; or

  3. 3.3

        as regards a broadcast, the country from which the broadcast was first made4.

Copyright belonging to the Crown and Parliament and certain international organisations is dealt with separately5.
