224 Distribution of material online

After a period of considerable uncertainty as to the legal effect of various aspects of publishing online, the situation has now been clarified and online publication is now governed primarily by the restricted act of communication of the work to the public. This was introduced by the Copyright and Related Rights Regulations 20031, implementing the Information Society Directive2. The Information Society Directive also required Member States to introduce a distribution right, but this was already covered in UK law by the right to issue copies of a work to the public
