202 Postponement of application of the resale right to sales of works of deceased artists

The Artist’s Resale Right Regulations 2006 Regulation 17 originally provided that the resale right in respect of the works of a deceased author cannot be exercised in respect of any sale where the contract date is before 1 January 2010. This provision was introduced by way of the exercise of an option available under the EC Directive 2001/84/EC to those Member States (such as the UK) which did not have a resale right as at the date of entry into force of the Directive
