201 Transitional provisions

The Artist’s Resale Right Regulations 2006 (‘the Regulations’) do not apply to sales where the contract date preceded the commencement of the Regulations, namely 14 February 2006. However, they do apply notwithstanding that the work sold was made before that date1.

Where the author of a work died before commencement of the Regulations, and was at his death a qualifying individual (within the meaning of Regulation 10(3) as originally enacted)2, then Regulation 16(2) of the Regulations specifies to whom the resale right in that work is deemed to have been transmitted.
