196 Requirements as to nationality etc

The Artist’s Resale Right Regulations 2006 set out certain nationality requirements for a resale right. A resale right is based on reciprocity and, accordingly, can be exercised in respect of the sale of a work where the author of the work is living at the date of the sale and is at that date a national of an EEA State or a State the legislation of which permits resale right protection for authors from EEA states and their successors in title1.
