189 Artist’s resale right

An entirely new (and controversial) intellectual property right, the Artist’s Resale Right, was introduced into UK law on 14 February 2006 by the Artist’s Resale Right Regulations 20061 (‘the Regulations’). The Regulations implemented the EC Directive 2001/84/EC on the resale right for the benefit of the author of an original work of art. The new right is controversial because the UK opposed the introduction of it (as it had previously opposed the introduction of droit de suite, on which the Artist’s Resale Right is based, into the Berne Convention2) on the ground that
