166 Transitional provisions

The Copyright, Designs and Patents Act 1988 Sections 96 and 97 apply to works created before this Act came into force but only in respect of copyright infringements committed after such date1. The right to delivery up2 or seizure of infringing copies3 applies to infringing copies or other articles made before as well as after such date4, but in practice action against most pre-commencement infringements are now statute-barred5 unless the copyright owner was, during the whole or any part of the six year period from the date the infringing copy/article was made, under a disability6 or prevented
