146 Licences to reflect payments for underlying rights

In considering what charges should be paid for a licence on a reference or application relating to licences for the rental or lending of copies of a work, or for a licence on any application for a royalty or other sum under the Copyright, Designs and Patents Act 1988 Section 142, the Tribunal shall take into account any reasonable payments which the owner of the copyright is liable to make, as a consequence of granting the licence, to owners of copyright in works that are included in that work1.
