138 Reference of a proposed licence

A proposed licence may be referred to the Copyright Tribunal1 and the provisions with regard to the making of an order and the duration of the order are the same as for a proposed licensing scheme2. However, the referral must be by the proposed licensee and not a representative body, as the licence will be individual to that licensee if granted and not relevant to a whole class of potential licensees.
