101 Incidental recording for the purposes of broadcasts

This is the so-called ‘ephemeral recording right’. It applies when a person is authorised by the copyright owner to broadcast a literary, dramatic or musical work (or an adaptation of such a work), an artistic work or a sound recording or film. It provides that such person is to be treated as licensed by the owner of the copyright in the work in question to make or authorise the making of certain copies of the work for the purposes of the broadcast1.
