31 Liability extinguished by order of a magistrates’ court

Where a person is liable by reason of tenure, enclosure or prescription to maintain a highway, a magistrates’ court may on complaint by that person or by the highway authority for the highway make an order extinguishing the liability of that person and the highway will then become a highway maintainable at the public expense1.
