61 Japan: compulsory licence

Where a work has been published the work may be exploited under the authority of a compulsory licence issued by the Commissioner of the Agency for Cultural Affairs on depositing on behalf of the copyright owner the amount which is fixed by the Commissioner as a royalty where the copyright owner cannot be found by virtue of the fact that they are unknown or for other reasons1.

A person who has applied for a compulsory licence may exploit the work in respect of which the application has been made by the means stated in the application while this
