52 India: civil and criminal liability for infringement

Where the copyright in any work has been infringed the owner of that copyright, including any exclusive licensee1 is entitled to civil remedies of injunctive relief, damages and accounts of profits2. Where the name of any person purporting to be the author or publisher of any literary, dramatic, or musical or artistic work or cinematograph film or sound recording appears on copies of any published work or cinematograph film or sound recording, that person shall be presumed to be the author or publisher unless the contrary is proved3.
