48 India: term of copyright protection

The term of copyright in any published literary, dramatic, musical or artistic work until 60 years from the beginning of the calendar year in the year next following the year in which the author dies1. In the case of joint authors the period is established by reference to the date of death of the last surviving author. Prior to the Copyright (Amendment) Act 2012 the term of protection for photographs (included within the definition of ‘artistic works’) was calculated by reference to first publication2.
