47 India: assignment and licensing of copyright, termination of transfers of copyright, relinquishment of copyright

In addition to the provisos introduced by the Copyright (Amendment) Act 2012, there are specific provisions which apply to all assignments and licences of copyright. The assignment or licence must be in writing and signed by the assignor or licensor or duly authorised agent1.

Where the assignee or licensee does not exercise the rights granted within a period of one year from the date of grant the assignment or licence is deemed to have lapsed at the end of this period unless otherwise specified in the
