46 India: transfer of copyright and registration of copyright

The provisions relating to the transmission of copyright are also derived from former UK legislation but they contain some important differences. The Copyright Act 1957 provides that copyright may be assigned1 or licensed2 but any assignment or licence of any future work will take effect only when the work comes into existence3. The 2012 Amendment Act, however, added three important provisos to the existing provisions which apply to assignments of copyright only and do not apply to licences.
