It is important from the point of view of a producer entering into a pre-sale agreement with a distributor in a territory to limit the distributor’s expenditure on the cost of prints and advertising. If these costs are monitored closely by the producer, the distributor may be encouraged to eliminate waste. It is also in the interests of the producer to ensure that a minimum amount is spent on publicising the film, and the producer may therefore require the distributor under a pre-sale agreement to expend a certain minimum sum on prints and advertising.
