316 Recoupment of production finance

The precise order and method of recoupment of investments is capable of a great number of variations. Whilst many agreements will provide for all equity investors to recover their investment pro rata pari passu, individual circumstances may require one investor to be repaid investment and interest in priority to the other investors, who may then be repaid pro rata pari passu or in successive tranches. Alternatively, an investor may require repayment of a specified percentage of gross receipts from a film, and this percentage may represent a substantial proportion of the net amount of receipts
