286 Practical advice on performers’ clearances

There are a number of practical precautions which might be taken by producers. As a general guideline, material should not be incorporated in any work unless:

  1. 286.1

        the person making available the material is prepared to warrant that it does not infringe any performers’ rights (in addition to the other normal copyright warranties);

  2. 286.2

        the person supplying the material is prepared to indemnify the producer; and

  3. 286.3

        the producer is satisfied that the person giving the indemnity is of sufficient substance to perform their indemnity obligations; and

  4. 286.4

        the consent extends (where appropriate)
