28 Brazil: provisions relating to audio-visual works

Where the author or performer of a literary, artistic or scientific work has authorised the production of an audio-visual work incorporating that literary, artistic or scientific work, the authorisation shall also constitute authorisation for commercial exploitation subject to agreement to the contrary1.

If exclusivity of authorisation is desired, this is required to be written into a specific clause in a written agreement and will lapse on the expiry of 10 years from the date the agreement is entered into2.

The producer of an audio-visual work is required to ensure that each copy of the audio-visual
