277 Recapture and turnaround

In addition to the termination rights created by statute1, two additional types of termination rights are frequently encountered in contractual provisions. The first of these is a straightforward recapture provision which specifies that a licence will expire and all rights automatically revert to the author/owner after a specified period if the producer has not by the end of that period carried out certain actions. Frequently, the provision is tied into the commencement of principal photography of the film or series.
