268 Existing material in public domain

A producer will frequently wish to use existing material originated by third parties as a basis for a screenplay. If such material is in the public domain, the producer will not need to acquire rights but will be obliged to establish that the material is in fact in the public domain:

  1. 268.1

        under the laws of its country of origin; and

  2. 268.2

        in the United Kingdom; and

  3. 268.3

        in all countries which are signatories to the Berne Convention; and

  4. 268.4

        in countries which are signatories to the Universal Copyright Convention.
