267 Literary material commissioned by producer

Commissioned literary or dramatic material1 is the most straightforward category of underlying work as it falls entirely within the producer’s control. Material commissioned by a producer generally consists of an original outline or treatment or screenplay which does not involve third party rights. The rights in this material are usually acquired by the producer outright, in many cases by way of future assignment of copyright before such material is created. Where a screenplay commissioned by a producer is based on copyright material, the ownership of the screenplay will vest in the producer,
