258 Enforceability of agreements with individuals generally

In negotiating agreements with individuals, particular care must be taken, even where the individual is legally represented, to eliminate the possibility of the agreement being unenforceable by reason of its being in restraint of trade, or by reason of its being entered into as a result of undue influence or duress.
