249 Unauthorised access with intent to commit or facilitate commission of further offences

An offence is committed if a person obtains unauthorised access with the intention of committing or facilitating any further offence for which the sentence is fixed by law, or for which a person of 21 years of age or over (not previously convicted) might be sentenced to imprisonment for a term of five years1.

A person will be guilty even where the commission of a further offence is impossible2, and it is immaterial whether any further offence is to be committed on the
