248 Unauthorised access to computer material

The Computer Misuse Act 1990 provides that a person is guilty of an offence if1:

  1. 248.1

        that person causes a computer to perform any function with intent to secure access to any program or data held in any computer;

  2. 248.2

        the access which the person intends to secure is unauthorised; and

  3. 248.3

        the person who causes the computer to perform the function knows at the time that this is the case.

For an offence to be committed it is not necessary for a person's actions to be directed towards any particular program,
