There is a right of appeal against a decision to refuse disclosure to the Information Commissioner who has the power to overrule a decision not to disclose, subject to an appeal to the Information Tribunal1. Section 53 of the Freedom of Information Act 2000 preserves a ministerial veto of a decision by the Information Commissioner on the production of a signed certificate stating that he/she has on reasonable grounds formed the opinion that the information is exempt from the duty of disclosure.
