220 Liability for publication

Every person or company that publishes or participates in the publication of defamatory matter will be liable as a publisher but an employer is liable for the defamatory publication of employees if made in the course of employment.

Subject to the defences of ‘innocent dissemination’ and ‘offer of amends’1 there are no defences that apply exclusively to publishers, printers and authors.

Publishers, printers and authors are jointly and severally liable for the publication of a libel. A claimant can therefore elect to sue any one or more of them and, subject to different considerations applying to each party
