196 Infringement of rights of person having recording rights and permitted acts

There are three specific acts of infringement of the rights of a person having recording rights: making a recording of a performance, using a recording made without consent and importing, possessing or dealing with an illicit recording.

Section 186 of the Copyright, Designs and Patents Act 1988 provides that a person infringes the right of a person having recording rights in relation to a performance if they make a recording of the whole or a substantial part of that performance without the consent of the person having recording rights
