172 Assertion of right to be identified

The right to be identified is not infringed unless it has been asserted in accordance with the provisions of the Copyright, Designs and Patents Act 19881. The right may be asserted in the following ways:

  1. 172.1

        on an assignment of copyright in the work, by including a statement that the author or director asserts the right to be identified2; or

  2. 172.2

        by an instrument in writing signed by the author or director3; or

  3. 172.3

        in the case of the public exhibition of an artistic work, by securing that the author is identified on
