166 Remedies for infringement of copyright or database right

In an action for infringement of copyright (including rental right) or database right, the reliefs available to the copyright or database right owner are the same as for any other property right1.

Where in an action for infringement of copyright or database right it is shown that at the time of the infringement the defendant did not know and had no reason to believe that copyright subsisted in the work to which the action relates, the claimant will not be entitled to damages, without prejudice to their right to any other remedy2.
