121 Classification of works protected by copyright and database right

Under the Copyright, Designs and Patents Act 1988 copyright is capable of subsisting in ten types of work, which are divided into four categories, as follows1:

  1. 121.1

        original literary, dramatic, musical or artistic works;

  2. 121.2

        sound recordings, films, broadcasts or cable programmes;

  3. 121.3

        the typographical arrangement of published editions; and

  4. 121.4

        databases2.

The Copyright and Related Rights Regulations 1996 introduced specific provisions in relation to satellite broadcasts and introduced a new cable retransmission right, publication right, and rental right but did not otherwise alter the above
