100 Council Directive (EC) 96/9 on the legal protection of databases

Council Directive (EC) 96/9 on the legal protection of databases recognised the fact that the making of databases requires an investment of considerable human, technical and financial resources and that a number of European Union states had failed sufficiently to protect the rights of database owners which were not protected under UK copyright legislation because of the failure to satisfy the originality criterion1.

The Directive provides for the copyright protection of databases which, by reason of the selection or arrangement of their contents, constitute the author’s own intellectual creation2. A
