71 Role of European Commission

Where it has been decided that a transaction is concentrative and that it has a Community dimension, the EC Merger Regulation confers exclusive jurisdiction on the Commission and national merger legislation cannot apply1. The parties must then notify the Commission following the conclusion of the agreement, or the announcement of a public bid, or the acquisition of a controlling interest and, in either case, before the implementation of any agreement2.
