3: ANCILLARY ORDERS

240 Ancillary orders

When approving a scheme of arrangement to effect a reconstruction or merger, but not a demerger or division, the court may, either as part of the order giving its approval or by means of a later order, make provision for any of the following matters1:

  1. 240.1

        the transfer to the acquiring company of the whole or any part of the undertaking, property or liabilities of the original company2;

  2. 240.2

        the allotting or appropriation by the acquiring company of any of its shares, debentures, policies or similar interests, to any person entitled to them under the
