171 Insider dealing and the Criminal Justice Act 1993

The insider dealing provisions under the Criminal Justice Act 1993 will also be relevant where the target company is listed on the Official List. The Criminal Justice Act 1993 creates three criminal offences of insider dealing1:

  1. 171.1

        dealing in price-affected securities2 while in possession of insider information3 in relation to those securities;

  2. 171.2

        encouraging another person to deal in price-affected securities (whether or not that other person knows they are price-affected securities), knowing or having reasonable cause to believe that the dealing would take place in such circumstances; and

  3. 171.3

        disclosing
