166 Director’s disqualification

The parties to a buy-out facilitated by equity finance should remember that a person can be disqualified from acting as a director of a company under the Company Directors Disqualification Act 1986 Section 6 if the court is satisfied that the conduct of the person as a director or shadow director of an insolvent company (either taken alone or taken together with his conduct as a director of one or more other companies or overseas companies) makes him unfit to be concerned in the management of a company1.
