5 Restrictions on appointment of directors

The following restrictions are placed on the appointment of a director:

  1. 5.1

        Bankruptcy: It is an offence for an undischarged bankrupt to act as a director or directly or indirectly to take part in or be concerned with the promotion, formation or management of a company except with the leave of the court by which he was adjudged bankrupt1.

  2. 5.2

        Disqualification: The court has power in certain circumstances to make orders disqualifying a person from being a director of a company for a specified period2. It
