71 Railways and transport systems

The Secretary of State is empowered under the Transport and Works Act 1992 to authorise the compulsory acquisition of land for the purposes of constructing or operating certain kinds of transport system1. Such an order is subject to special parliamentary procedure to the same extent as if authorised under the Acquisition of Land Act 1981 Section 2(1) and particular provision is made for public rights of way2. The Secretary of State is also empowered to make rules governing the procedure for applications and objections and to prescribe model forms3.
